Privacy policy
THE MÖNKY LAB respects your privacy and is committed to protecting your personal data. This policy explains what data we process, for what purpose, on what legal basis, with whom we share it and what rights you have, in accordance with Regulation (EU) 2016/679 (GDPR) and Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD).

THE MÖNKY LAB is not required to appoint a Data Protection Officer. For any matter relating to your data, you can contact the email address indicated.
2. What data we process, for what purpose and on what legal basis
This website has no contact forms of its own and does not automatically collect data for advertising purposes. We process personal data only in the following cases:
- Handling your enquiries. When you write to us by email, call us or contact us via WhatsApp, we process your name, your contact details (email or phone) and the content of your message, in order to handle your enquiry and, where applicable, prepare a proposal for you. Legal basis: your consent and the application of pre-contractual measures requested by you (art. 6.1.a and 6.1.b GDPR).
- Appointment booking. If you book an appointment, it is managed through Calendly. The data you provide (name, email and chosen time slot) is processed to schedule and confirm the meeting. Legal basis: your consent and pre-contractual measures (art. 6.1.a and 6.1.b GDPR).
- Management of the client relationship. If we engage services, we process the identifying, contact and billing data necessary to provide the service and comply with our obligations. Legal basis: the performance of the contract and compliance with legal obligations, in particular tax and accounting ones (art. 6.1.b and 6.1.c GDPR).
- Commercial communications. Only if you give us your consent, or within the framework of an existing contractual relationship, may we send you information about our services. Legal basis: your consent (art. 6.1.a GDPR), which can be withdrawn at any time.
3. Origin and accuracy of the data
The data we process comes from the data subject themselves. You warrant that the data you provide us is true and current, and you undertake to notify us of any changes. If you provide third-party data, you confirm that you have their consent and that you have informed them of the processing.
4. Minors
Our services and this site are not aimed at children under 14. We do not knowingly collect data from minors without the consent of those who hold parental authority or guardianship over them.
5. Recipients and data processors
We do not transfer your data to third parties, except where legally required. To provide our services we rely on providers acting as data processors, with whom we have signed the contracts required by art. 28 of the GDPR. These providers include, among others, web hosting, email, appointment management (Calendly), messaging (WhatsApp, from Meta), the embedded map (Google Maps) and web fonts (Google Fonts). In particular, this site loads Google Fonts on every visit, which involves a connection to Google's servers (Google LLC, USA) that may process your IP address. Each one processes the data solely in accordance with our instructions and for the purposes described.
6. International transfers
Some of these providers (for example Calendly, Google or Meta) may process data in countries outside the European Economic Area. In such cases, those transfers are covered by the safeguards provided for in the GDPR, such as the European Commission's adequacy decisions or the standard contractual clauses.
7. Retention periods
We keep your data for as long as necessary for the purpose for which it was collected: while we handle your enquiry and, if we begin a relationship, for its duration. Once ended, we keep it blocked during the limitation periods for liabilities and those legally required, in particular the tax and commercial periods. Data processed on the basis of your consent is kept until you withdraw it.
8. Automated decisions
We do not make automated decisions or carry out profiling with legal or significant effects on you based on your data.
9. Your rights
You may exercise the following rights at any time by writing to hola@themonkylab.agency, proving your identity and indicating the right you wish to exercise:
- Access to your personal data.
- Rectification of inaccurate or incomplete data.
- Erasure of your data when it is no longer necessary.
- Objection to the processing in certain circumstances.
- Restriction of the processing in the cases provided for.
- Portability of your data to another controller.
- Withdrawal of the consent given, without this affecting the lawfulness of the prior processing.
We will respond to your request within a maximum of one month. If you consider that we have not processed your data in accordance with the regulations, you have the right to lodge a complaint with the Agencia Española de Protección de Datos (aepd.es).
10. Cookies
This site does not install analytics, advertising or tracking cookies. Technical third-party cookies may only be generated when the Google Maps map embedded on the contact page is loaded, and only if you accept its loading; they are necessary for that content to work. The loading of Google Fonts described in the previous section does not set cookies, although it does involve a connection to Google. You can accept or reject cookies from the cookie notice, and manage or delete them at any time from your browser settings.
11. Security measures
We apply the appropriate technical and organisational measures to ensure a level of security suited to the risk and to protect your data against destruction, loss, alteration or unauthorised access.
12. Changes to this policy
We may update this policy to adapt it to legislative developments or changes in our services. The version in force will always be the one published on this site.
